Right of Withdrawal & Cancellation Form
Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed:
A. Right of Withdrawal Policy
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
Notwithstanding this, in the case of a contract for the regular delivery of goods over a fixed period, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the first goods.
To exercise your right of withdrawal, you must inform us (Kallisbest Pets Love Verwaltungs GmbH, Frohnradstraße. 22, 63768 Hösbach, Germany, Tel.: +49-6021-44239-0, Fax: +49-6021-44239-70, E-Mail: info@kallisbest.de) by means of a clear declaration (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You can use the attached sample withdrawal form, but this is not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract was received by us. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the quality, characteristics and functionality of the goods.
Exclusion or premature expiry of the right of withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded.
The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
Special notes for pet food & groceries
Pet food and groceries are subject to special storage and hygiene requirements. For this reason, the following restrictions on the right of withdrawal apply:
Opened goods: The right of withdrawal expires for sealed goods that are not suitable for return for hygiene reasons as soon as the seal has been removed after delivery (§ 312g para. 2 no. 3 BGB).
Improper storage: Since pet food – especially dry food – requires special storage conditions (dry, cool, protected from light), we cannot resell returned goods for which proper storage cannot be ensured, for reasons of consumer protection and food safety. Such goods must therefore be destroyed.
Unopened goods: For goods in their original, unopened packaging, the statutory right of withdrawal of 14 days applies. Please ensure that the goods are returned in perfect condition and in their original packaging.
We ask for your understanding that we cannot resell returned pet food in case of doubt and that it must therefore be destroyed. This serves exclusively to protect the health of your animals.
General information
1) Please avoid damage and contamination of the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure sufficient protection against transport damage with suitable packaging.
2) Please do not send the goods back to us freight collect.
3) Please note that the aforementioned points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
